Welcome to Trackly. By using our mobile application, you agree to these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By accessing or using Trackly, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the app.
2. Description of Service
Trackly is a job tracking application that:
- Aggregates job postings from 40+ companies
- Filters jobs by role type (PM, Strategy & Ops, Partnerships)
- Sends push notifications for new job postings (Pro subscription)
- Provides company metrics and job insights
Important: Trackly is a job aggregator. We do not employ job seekers, nor do we guarantee employment. All job applications are handled directly by the hiring companies.
3. Account Registration
Eligibility
- You must be at least 18 years old
- You must provide accurate information
- One account per person
Account Security
- You are responsible for maintaining account security
- We use OAuth (Apple/Google) - no passwords are stored
- Notify us immediately of unauthorized access
4. Subscription and Billing
Free Tier
- View all job postings
- Filter by role and location
- Track 40+ companies
Pro Subscription ($29.99/month)
- Everything in Free tier
- Instant push notifications for new jobs
- Priority support
- Early access to new features
Billing Terms
- Subscriptions are processed via Apple In-App Purchase
- Charged monthly to your Apple ID payment method
- Auto-renewal unless canceled 24 hours before period ends
- Manage subscription in iOS Settings → Apple ID → Subscriptions
No Refunds: Subscription fees are non-refundable except as required by law. If you cancel mid-cycle, you retain access until the end of the billing period.
Cancellation
You can cancel your subscription anytime:
- iOS Settings → Your Name → Subscriptions → Trackly → Cancel
- Cancellation takes effect at the end of the current billing period
- No partial refunds for unused time
5. Acceptable Use
You agree NOT to:
- Scrape, spider, or automatically extract job data
- Reverse engineer or decompile the app
- Share your account credentials
- Use the app for illegal purposes
- Spam or harass other users (if we add social features)
- Circumvent subscription payment mechanisms
- Submit false or misleading information
6. Job Posting Accuracy
No Guarantee of Accuracy: Trackly aggregates job postings from third-party sources. We make reasonable efforts to ensure accuracy, but we do not guarantee that:
- All job postings are current or still accepting applications
- Job details (salary, location, requirements) are accurate
- Companies will respond to your application
Always verify job details directly with the hiring company.
7. Intellectual Property
Trackly and its original content, features, and functionality are owned by Kevin Astuhuamán and are protected by:
- International copyright laws
- Trademark laws
- Other intellectual property rights
Company logos and job posting content belong to their respective owners.
8. Third-Party Links
Trackly contains links to external job application pages. We are not responsible for:
- Content on third-party websites
- Privacy practices of external sites
- Job application processes or outcomes
9. Disclaimers
No Employment Guarantee
Trackly is a tool to discover job opportunities. We do not:
- Guarantee employment or interviews
- Endorse any specific employer
- Review or verify job postings for legitimacy
- Participate in hiring decisions
Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. The app may be unavailable due to:
- Maintenance and updates
- Third-party service outages
- Force majeure events
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Trackly is provided "AS IS" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid in the past 12 months
- We are not responsible for failed job applications or missed opportunities
11. Termination
By You
You may delete your account anytime via Settings → Delete Account.
By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse the service or other users
Upon termination:
- Your data will be deleted within 30 days
- Active subscriptions remain until the end of the billing period (no refunds)
- You lose access to all Pro features immediately
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via:
- In-app notification
- Email to your registered address
- Updated "Last updated" date
Continued use after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules.
